1.
About these terms
These Terms & Conditions apply to The Sewing Studio Johannesburg, including bookings made through our Shopify website and bookings arranged directly with us by WhatsApp, email, phone, in person or another agreed communication channel.
By making a booking, accepting a manual invoice or purchasing a product, you agree to the terms that apply to that transaction, subject always to rights that cannot lawfully be excluded under South African law.
2.
Bookings, invoices & payment
A class or course place is confirmed once the required payment has been received or we have otherwise confirmed the booking in writing.
Online bookings may be processed through Shopify and PayFast. We also accept manual or offline bookings arranged directly with us, for which we may issue a manual invoice and record payment outside Shopify. The same class and course booking rules apply to both online and manually arranged bookings.
Please check the course, dates, times and participant details before paying.
Class & course rescheduling at a glance
Give at least 48 hours’ notice. A session may be moved once only, the replacement must be used within 30 days of the original session date, and all moves are subject to availability.
3.
Classes, courses, cancellations & refunds
Our standard policy is that payments for classes, courses and workshops are non-refundable for customer-requested cancellations. If you cannot attend, we offer rescheduling in accordance with the rules below rather than a voluntary cash refund.
This policy does not remove any cancellation, refund or other remedy that you are entitled to under applicable South African consumer law. Where the law gives you a right to cancel, any cancellation charge applied by us will be reasonable in the circumstances as required by law.
4.
48-hour rescheduling rule
You may request to move a booked class or individual course session by contacting us at least 48 hours before the scheduled start time.
- Each booked session may be rescheduled once only.
- The replacement session must be used within 30 days of the original booked date.
- All replacement dates are subject to space and instructor availability.
- A rescheduled booking cannot be repeatedly moved.
Where less than 48 hours’ notice is given, the session will normally be forfeited and no voluntary refund or replacement session will be provided, subject to any rights or remedies required by law.
5.
Missed sessions & multi-week courses
The 48-hour rescheduling rule applies to individual sessions within a multi-week course as well as single-session bookings. A student who misses a session without arranging a valid reschedule will normally forfeit that session.
When a replacement lesson is available, we will place the student into a suitable session within the 30-day rescheduling window. We cannot guarantee that the same instructor, day or time will be available.
6.
Changes or cancellations by The Sewing Studio
We may occasionally need to change an instructor, time or date because of illness, operational requirements or circumstances outside our reasonable control. We will contact affected students as soon as reasonably possible.
If The Sewing Studio Johannesburg cancels a class or course session, we will offer an appropriate alternative date, transfer or other remedy in accordance with the circumstances and applicable law. Our customer 48-hour rescheduling limit does not apply to a cancellation made by us.
7.
Seats & availability
Class sizes are limited and all bookings are subject to availability. A class added to an online cart is not necessarily reserved until checkout and payment are completed. For a manual booking, a place is not secured until we confirm it and the required payment has been received or otherwise agreed.
8.
Physical products & size exchanges
For clothing purchased from us, we offer a size exchange requested within 14 days of delivery, subject to stock availability.
To qualify for our voluntary size-exchange policy, the item must be unworn, unused, unwashed and returned with its original tags and packaging in a resalable condition.
We do not offer voluntary returns or refunds simply because a customer has changed their mind. This voluntary store policy does not limit any cooling-off, return, refund or other statutory rights that may apply to a particular transaction under South African law.
9.
Return & courier costs
For an ordinary size exchange or another customer-requested return that we agree to accept, the applicable courier or return-delivery charges are for the customer’s account. Where a refund is lawfully due and we are permitted to do so, the actual applicable courier or return-delivery cost may be deducted from the refunded amount.
Where an item is faulty, defective, damaged on delivery or incorrectly supplied by The Sewing Studio Johannesburg, return and delivery costs will be handled in accordance with applicable consumer law, including any circumstances in which those costs must be carried by us.
10.
Faulty, damaged or incorrectly supplied goods
Please contact us promptly if an item is faulty, damaged on delivery or is not the item you ordered. We will assess the issue and provide the repair, replacement, refund or other remedy required by applicable South African consumer law.
Nothing in these Terms & Conditions limits the statutory warranty or remedies that apply to defective goods.
11.
Materials, equipment & what to bring
What is supplied and what you need to bring is shown on the relevant course page or communicated when a manual booking is made. Please follow any fabric, preparation or equipment instructions for your course. Sewing machines and studio equipment must be used in accordance with the instructor’s directions.
12.
Health, safety & studio conduct
Sewing equipment includes sharp and moving parts. Students must follow reasonable studio safety instructions and use equipment responsibly. We may ask a participant to stop using equipment or leave a session if their conduct creates an unreasonable safety risk or materially disrupts the class.
13.
Students under 18
For programmes offered to students under 18, the booking must be made or authorised by a parent or legal guardian. The parent or guardian is responsible for providing accurate contact information and any information reasonably necessary for the student’s safe participation.
14.
Website content & intellectual property
We aim to keep course descriptions, dates, prices, product information and other website content accurate and up to date. Course materials, original patterns, teaching resources, branding, photographs and website content remain protected by applicable intellectual-property rights and may not be copied or commercially redistributed without permission.
15.
Liability & consumer rights
Nothing in these terms is intended to exclude or limit any liability, statutory warranty or consumer right that cannot legally be excluded. To the extent permitted by law, we are not responsible for indirect loss that was not reasonably foreseeable or for loss caused by a customer’s failure to follow reasonable studio instructions.
16.
Privacy
We process personal information in accordance with our Privacy Policy. This includes information collected through our website as well as information received through manual bookings, invoices and direct communications.
17.
Changes to these terms
We may update these terms from time to time. The version in effect when a booking or purchase is made will generally apply to that transaction, unless a change is required by law or specifically agreed with you.
18.
Governing law & contact details
These terms are governed by the laws of the Republic of South Africa, subject to all applicable consumer-protection rights.
